By accessing or using WeatherRank ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

2. Description of Service

WeatherRank is a community-driven platform that allows users to:

• Submit real-time weather ratings for their current location or any city worldwide
• View aggregated weather ratings submitted by other users
• Browse weather trends and historical data on an interactive map
• Access city-specific weather rating statistics and visualizations
• Compare weather conditions across different locations

The Service is provided "as is" and is intended for informational and entertainment purposes only. Weather ratings are subjective opinions submitted by individual users and should not be relied upon for critical decision-making.

3. User Eligibility and Accounts

3.1 Age Requirements

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service.

3.2 No Account Required

WeatherRank does not require user registration or account creation. However, we implement rate limiting measures to prevent abuse, as described in Section 5.

4. User Submissions and Content

4.1 Rating Submissions

When you submit a weather rating, you provide:

• A numerical rating (0-10) representing your subjective assessment of current weather conditions
• The name of the city you are rating
• Timestamp of submission (automatically recorded)
• Geographic coordinates (obtained via geolocation or city lookup, used for map display only)

4.2 License Grant

By submitting a rating, you grant WeatherRank a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display your submitted data in connection with the Service.

You retain ownership of your submissions, but acknowledge that ratings become part of aggregated, anonymized datasets that may be displayed to other users or used for analytical purposes.

4.3 Prohibited Conduct

When using the Service, you agree NOT to:

• Submit false, misleading, or inaccurate information
• Attempt to manipulate ratings or game the system through automated submissions
• Submit ratings for locations you are not currently in or have no knowledge of
• Use the Service to harass, abuse, or harm others
• Circumvent rate limiting measures or attempt to submit multiple ratings within the restricted timeframe
• Use automated tools, bots, scripts, or scrapers without express written permission
• Attempt to gain unauthorized access to the Service or its underlying systems
• Introduce malicious code, viruses, or harmful content
• Reverse engineer, decompile, or disassemble any portion of the Service
• Violate any applicable local, state, national, or international law

4.4 Content Moderation

We reserve the right, but do not have the obligation, to monitor, review, or remove any user submissions that violate these Terms or are otherwise objectionable. We may remove ratings that appear fraudulent, abusive, or inconsistent with legitimate use.

5. Rate Limiting and Anti-Abuse Measures

5.1 Submission Limits

To prevent abuse and ensure fair usage, users are limited to one (1) rating submission per hour per IP address. This limitation applies across all cities and locations.

5.2 IP Address Hashing

For rate limiting purposes, we collect and hash your IP address using cryptographic hashing algorithms (SHA-256). The hashed value is stored temporarily (24 hours) and cannot be reverse-engineered to identify you. See our Privacy Policy for more details.

5.3 Enforcement

We may implement additional technical measures to prevent abuse, including but not limited to:

• Temporary or permanent IP blocks for repeated violations
• CAPTCHA verification for suspicious activity
• Enhanced monitoring for automated submission patterns
• Removal of submissions determined to be fraudulent

6. Data Usage and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection, use, and sharing practices.

We use Google Analytics, Google Ads, and Google Tag Manager to collect information about how you use the Service. These services may use cookies and similar technologies to:

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Weather ratings reflect objective meteorological conditions
• Any defects or errors will be corrected
• The Service is free from viruses or harmful components

9.2 Weather Information Disclaimer

IMPORTANT: Weather ratings on WeatherRank are subjective user opinions and DO NOT constitute professional meteorological advice or forecasts. Ratings should not be used for:

• Emergency planning or disaster preparedness
• Aviation, maritime, or transportation safety decisions
• Agricultural or construction planning
• Health-related decisions affected by weather conditions
• Any situation where accurate weather information is critical

Always consult official meteorological services for authoritative weather information.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEATHERRANK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to, use of, or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Reliance on weather ratings or information provided through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF ONE HUNDRED US DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

9.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless WeatherRank, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the Service
• Your submissions or any content you provide
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

11. Termination

11.1 Termination by Us

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Technical or security concerns
• Discontinuation of the Service

11.2 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.3 Data Retention After Termination

Submitted ratings and aggregated data may be retained after termination as described in our Privacy Policy, as this data forms part of the public dataset and cannot be individually retracted.

12. Geographic Restrictions

The Service is operated from Iceland and is intended for users worldwide. However, we make no representation that the Service is appropriate or available for use in all locations. Access to the Service may not be legal in certain countries or for certain persons. You are responsible for compliance with local laws if you access the Service from outside Iceland.

13. Dispute Resolution

13.1 Informal Resolution

If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally by sending written notice describing the nature and basis of the claim and the requested relief to vestra@vestra.is.

13.2 Mediation and Arbitration

If we cannot resolve the dispute through informal means within thirty (30) days, either party may initiate mediation or arbitration proceedings in accordance with Icelandic law. Any arbitration shall be conducted in Reykjavík, Iceland, in accordance with the rules of the Icelandic Arbitration Association or other mutually agreed arbitration body.

13.3 Jurisdiction

If arbitration is not pursued or is unavailable, any legal proceedings shall be brought exclusively in the competent courts of Reykjavík, Iceland. Both parties consent to the exclusive jurisdiction and venue of such courts.

13.4 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Iceland, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Reykjavík, Iceland for the purpose of litigating all such claims or disputes that are excluded from arbitration.

15. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeatherRank regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms at our sole discretion without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

16.6 Relationship of Parties

Nothing in these Terms shall be deemed to create an agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and WeatherRank.
